Terms of Service for Second Look

Please read these terms carefully before using Second Look. By using the app, you agree to these terms. If you don't agree, please don't use the app.

1. Acceptance of terms

These terms form a binding agreement between you and Siddhant Bajaj ("we," "us," "our"), governing your use of the Second Look app.

2. Eligibility

You must be at least 16 years old to use Second Look. By using the app, you confirm that you meet this requirement. We ask for your date of birth during onboarding to confirm you meet this requirement.

3. What Second Look does

Second Look lets you photograph an outfit and receive AI-generated feedback on it, based on an occasion you choose. This feedback is generated by an artificial intelligence model, not a professional stylist, and is provided for informational and entertainment purposes. We don't guarantee the accuracy, completeness, or usefulness of any feedback the app provides. See our Privacy Policy for more detail on how the AI analysis works.

4. Your account

You need an account to use Second Look. You create one before your first scan, with Sign in with Apple or with your email address and a code we send to it. Your free scans, History, ratings and any subscription belong to that account. You're responsible for keeping your account secure and for all activity under it.

5. Subscriptions and billing

Second Look offers optional paid subscriptions that unlock additional features. Subscription tiers, their length, and their current price are shown in the app and in the App Store listing at the time of purchase. This is the authoritative source for current pricing, since it can change.

• Subscriptions automatically renew at the same price and duration you agreed to, unless canceled at least 24 hours before the end of the current period.
• Payment is charged to your Apple ID account upon confirming purchase, and renewal charges occur within 24 hours prior to the end of the current period.
• The current subscription period cannot be canceled mid-term once purchased; cancellation takes effect at the end of the current period.
• You can manage or cancel your subscription anytime in your Apple ID account settings. We cannot cancel it for you directly, since we never have access to your billing relationship with Apple.
• If a free trial is offered, any unused portion of that trial is forfeited the moment you purchase a paid subscription.

6. Refunds

We do not process refunds directly. All purchases go through Apple, and all refund requests are handled by Apple according to their own policies. If you want a refund, please contact Apple support or use Apple's Report a Problem tool.

7. Free scans and fair use

Without a subscription, Second Look includes 3 free scans per person, each with the full result. Free scans belong to your Apple ID or email address, so deleting an account and signing in again doesn't restore them. After that, a subscription is needed to keep scanning. These limits are subject to change. The limits shown inside the app at the time you use it are always the current, authoritative ones, regardless of what's written here.

Subscriptions include generous daily use for personal styling. We may limit unusually heavy or automated use.

8. Acceptable use

You agree not to:

• Use the app for any unlawful purpose
• Attempt to interfere with, disrupt, or gain unauthorized access to the app, our servers, or other users' accounts
• Attempt to reverse-engineer, extract, or misuse the underlying AI systems or the rules that govern them
• Upload photos that are not your own outfit or that depict another person without their knowledge and consent
• Use the app to harass, exploit, or generate content intended to harm yourself or anyone else

We may suspend or terminate access for anyone who violates these terms.

9. Photos and content you provide

You retain all rights to the photos you take or select in the app. As explained in our Privacy Policy, your photos are never stored by us. They are used to generate your feedback, and our AI provider keeps them only for the limited time our Privacy Policy describes. By using the app, you grant us and our AI provider the limited, temporary right to process your photo solely for that purpose, and you grant us the right to create and store the text descriptions and feedback derived from it, as described in our Privacy Policy.

You're responsible for making sure you have the right to share any photo you use with the app, including photos that include other people.

10. Intellectual property

The app, including its design, branding, and underlying technology, is our property or licensed to us. These terms don't grant you any rights to our intellectual property beyond what's needed to use the app as intended.

You may use the feedback generated for you freely for your own personal purposes. We retain rights in the underlying system that generates it, and may use aggregated, de-identified information for purposes like improving the app.

11. Indemnification

You agree to defend, indemnify, and hold us harmless from any claim, damage, or expense (including reasonable legal fees) arising from your violation of these terms, your misuse of the app, or content you upload, including claims brought by someone else depicted in a photo you submitted without their consent.

12. Disclaimers

Second Look is provided "as is," without warranties of any kind, express or implied. We don't warrant that the app will be uninterrupted, error-free, or that AI-generated feedback will meet your expectations or be accurate. Feedback provided by the app is not professional styling, medical, or psychological advice of any kind.

Some states, countries, or jurisdictions do not allow the exclusion of certain implied warranties, so some of the exclusions above may not apply to you.

13. Limitation of liability

To the fullest extent permitted by law, Siddhant Bajaj will not be liable for any indirect, incidental, or consequential damages arising from your use of the app, including reliance on AI-generated feedback. Our total liability for any claim relating to the app is limited to the greater of (a) the amount you paid for the app in the 12 months before the claim arose, or (b) 100 USD.

Some jurisdictions do not allow the limitation of certain damages, so some of the limitations above may not apply to you.

14. Termination

You may stop using the app and delete your account at any time. We may suspend or terminate your access if you violate these terms or if we discontinue the app.

15. General provisions

If any part of these terms is found unenforceable, the rest remains in full effect. These terms are the entire agreement between you and us regarding the app, superseding any prior agreements on the same subject. We may assign these terms in connection with a merger, acquisition, or sale of assets; you may not assign them without our consent. Our failure to enforce any part of these terms is not a waiver of our right to do so later. We are not responsible for delays or failures caused by circumstances beyond our reasonable control. Sections that by their nature should survive termination of these terms, including ownership, disclaimers, liability limits, and dispute resolution, do survive.

16. Apple-specific terms

Since Second Look is distributed through Apple's App Store, the following additional terms apply, for Apple's benefit:

• This agreement is between you and Siddhant Bajaj only, not with Apple, and Apple is not responsible for the app or its content.
• Apple has no obligation to provide maintenance or support for the app.
• In the event the app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price for the app to you; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
• Apple is not responsible for addressing any claims by you or a third party relating to the app or your possession or use of it, including product liability claims, claims that the app fails to conform to legal or regulatory requirements, and claims arising under consumer protection or similar legislation.
• Apple is not responsible for the investigation, defense, settlement, or discharge of any claim that the app or your possession and use of it infringes a third party's intellectual property rights.
• You represent that you are not located in a country subject to a U.S. government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. government list of prohibited or restricted parties.
• If you are using the app on behalf of the U.S. government, the app is a "Commercial Item" as defined in relevant federal acquisition regulations.
• Apple, and Apple's subsidiaries, are third-party beneficiaries of these terms, and upon your acceptance, Apple has the right to enforce these terms against you as a third-party beneficiary.

17. Dispute resolution and governing law

These terms are governed by the laws of the State of New York, without regard to conflict-of-law principles.

Before filing a claim against us, you agree to first contact us at support@secondlookai.app and give us 30 days to try to resolve the issue informally.

Any dispute that isn't resolved informally will be brought exclusively in the state or federal courts located in New York County, New York, and you consent to that venue and jurisdiction, except that either party may bring an individual claim in small claims court where available.

18. Changes to these terms

We may update these terms from time to time. If we make material changes, we'll update the effective date above and, where material, show a notice in the app before the changes take effect. Continuing to use the app after changes take effect means you accept the updated terms.
